Acceptance of Terms
By accessing or using CaseCapture AI’s Voice AI agent service (“Service”), you (“Customer” or “you”) agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not access or use the Service.
These Terms apply to all users of CaseCapture AI, including law firms, attorneys, and authorized personnel who use our Voice AI agent service.
Service Description
CaseCapture AI, operated by Epoch Point Group LLC, provides Voice AI agent technology that answers phone calls on behalf of family law firms. Our Service includes:
- Voice AI Agent: Artificial intelligence technology that handles inbound phone calls to your law firm
- Lead Capture: Conversation management and prospect qualification for family law matters
- Call Recording: Recording and transcription of all conversations for quality and training purposes
- Lead Management: Integration with your CRM and email systems for captured lead information
- Appointment Assistance: SMS calendar link distribution to qualified callers
- Call Transfer: Emergency escalation and transfer capabilities to designated attorneys
Important: CaseCapture AI provides technology services only. We do not provide legal advice, create attorney-client relationships, or practice law.
Customer Responsibilities and Content Control
Your Control Over AI Conversations
Customer acknowledges and agrees that they exercise significant control over the content and nature of conversations conducted by the AI agent, including:
- Questions Asked: Customer specifies what questions the AI agent should ask callers
- Information Collection: Customer determines what information should be gathered during calls
- Conversation Flow: Customer controls the general structure and topics of AI conversations
- Professional Compliance: Customer ensures all specified content complies with legal ethics and professional responsibility rules
Customer Responsibilities
Customer is solely responsible for:
- Providing accurate law firm information and contact details for service setup
- Ensuring compliance with all applicable legal profession rules and bar regulations
- Designating appropriate emergency contacts for urgent legal matters
- Maintaining confidentiality of sensitive client information shared during setup
- Ensuring all conversation content specifications comply with privacy laws and professional standards
- All aspects of information collection procedures they specify for the AI agent
Prohibited Uses
Customer may not use the Service to:
- Collect information in violation of applicable privacy laws
- Engage in practices that violate legal profession ethics rules
- Specify questions or procedures that could create unauthorized practice of law
- Use the Service for non-legal business purposes
- Attempt to access or reverse-engineer proprietary AI prompts or technology
Professional Responsibility and Legal Disclaimers
No Attorney-Client Relationship
IMPORTANT: No attorney-client relationship is created between CaseCapture AI and any caller, law firm, or attorney through use of this Service. The AI agent:
- Acts as Customer’s technology tool only
- Does not provide legal advice or opinions
- Does not create any attorney-client privilege
- Represents the law firm’s interests, not CaseCapture AI’s interests
Technology Service Provider Status
CaseCapture AI operates exclusively as a technology service provider. We:
- Provide Voice AI technology platform and execution capabilities
- Do not provide legal services, advice, or consultation
- Do not participate in attorney-client relationships
- Maintain proprietary AI prompts and technology as trade secrets
Customer remains solely responsible for:
- All professional liability and malpractice considerations
- Compliance with state bar association rules and regulations
- Maintaining appropriate professional liability insurance
- All aspects of the attorney-client relationship with their clients
Service Terms and Limitations
Voice AI Capabilities and Limitations
Customer acknowledges that Voice AI technology:
- Is not perfect: AI responses may contain errors or inaccuracies
- Has limitations: May not handle all conversation scenarios appropriately
- Requires oversight: Customer should monitor and review AI performance
- Cannot replace human judgment: Particularly for complex or sensitive legal matters
Service Availability
- Service is provided on an “as available” basis
- We do not guarantee 100% uptime or availability
- Scheduled maintenance may temporarily interrupt service
- Technical issues may cause service interruptions
Emergency Procedures
For urgent legal matters or emergencies:
- AI agent will attempt to escalate per Customer’s specified procedures
- Customer must provide clear emergency contact information
- Customer remains responsible for ensuring appropriate emergency response
- CaseCapture AI is not liable for emergency response delays or failures
Data Ownership and Privacy
Customer Data Ownership
Customer retains full ownership of:
- All call recordings and transcripts generated through the Service
- Lead information and contact details captured by the AI agent
- Case inquiry details and conversation content
- Any data exported from the Service
CaseCapture AI Data Usage
CaseCapture AI may:
- Use anonymized conversation data to improve AI technology and responses
- Retain conversation data for quality assurance and service improvement
- Access customer data as necessary to provide technical support
CaseCapture AI will not:
- Share identifiable customer data with third parties for marketing purposes
- Use specific customer information for competing law firm services
- Disclose confidential client information except as required by law

Billing and Payment Terms
Early Access Program
Current customers participate in our Early Access Program, which includes:
- Flexible month-to-month billing arrangements
- Potential pricing adjustments as service features evolve
- Priority access to new features and capabilities
- Direct input on service development and improvements
Payment Terms
- Fees are billed monthly in advance
- Payment is due within 30 days of invoice date
- Late payments may result in service suspension
- Pricing structure subject to change with 30 days’ advance notice
Cancellation and Refunds
- Customer may cancel service with 30 days’ written notice
- Prepaid fees for unused service periods may be refunded at our discretion
- Upon cancellation, Customer retains rights to export all data within 60 days
- Cancelled accounts may be subject to data deletion after 90 days
Intellectual Property
Proprietary Technology
CaseCapture AI retains all rights to:
- Proprietary AI prompts and conversation models (trade secrets)
- Voice AI technology platform and algorithms
- Service infrastructure and technical implementations
- CaseCapture AI trademarks, logos, and branding
Customer Content
Customer retains all rights to:
- Law firm branding and marketing materials provided for service setup
- Conversation content specifications and question frameworks
- Captured lead data and call recordings
- Any customer-generated content or materials
Limitation of Liability and Risk Allocation
Customer Liability for Content Control
CRITICAL: Since Customer controls the conversation content, questions asked, and information collection procedures, Customer acknowledges sole responsibility for:
- Compliance Issues: All legal ethics and professional responsibility compliance related to customer-specified conversation content
- Privacy Violations: Any privacy law violations resulting from customer-specified information collection procedures
- Professional Standards: Ensuring all customer-controlled content meets applicable professional standards
- Regulatory Compliance: Compliance with bar association rules and legal technology regulations
CaseCapture AI Liability Limitations
To the maximum extent permitted by law, CaseCapture AI’s liability is limited to:
- Maximum Liability: Total fees paid by Customer in the 12 months preceding any claim
- Technology Performance Only: Liability limited to technical service delivery issues
- No Consequential Damages: We are not liable for lost clients, revenue, or business opportunities
- No Professional Liability: We assume no responsibility for legal malpractice or professional errors
Exclusions
CaseCapture AI is not liable for:
- AI conversation errors or inaccuracies (technology limitation)
- Missed calls due to technical failures or maintenance
- Emergency situations requiring immediate human intervention
- Customer compliance failures or professional responsibility violations
- Data loss due to customer failure to export data upon cancellation
Indemnification
Customer agrees to defend, indemnify, and hold harmless CaseCapture AI from any claims, damages, or expenses arising from:
- Customer-specified conversation content or information collection procedures
- Customer’s use of the Service in violation of professional responsibility rules
- Privacy law violations related to customer-controlled data collection
- Any claim that customer-specified AI behavior violates applicable laws or regulations
- Customer’s failure to maintain appropriate professional liability insurance
Service Termination
Termination by Customer
Customer may terminate service at any time with 30 days’ written notice. Upon termination:
- Customer retains access to all data for 60 days
- CaseCapture AI will assist with data export upon request
- Final billing will be prorated for partial month usage
- Confidential information obligations survive termination
Termination by CaseCapture AI
We may terminate service immediately for:
- Non-payment of fees after 30 days past due
- Violation of these Terms or professional ethics requirements
- Use of Service for illegal purposes or unauthorized practice of law
- Customer specification of AI behavior that violates laws or regulations
Post-Termination
Upon any termination:
- Customer data will be retained for 90 days, then deleted
- Both parties’ confidentiality obligations continue indefinitely
- Customer remains liable for any outstanding fees
- These Terms survive termination as to post-termination obligations
Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
Any disputes arising under these Terms will be resolved through:
- Direct Discussion: Initial attempt to resolve disputes informally
- Mediation: If direct discussion fails, binding mediation in our jurisdiction
- Limited Litigation: If mediation fails, litigation limited to actual damages only
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be:
- Posted on our website with updated “Last updated” date
- Communicated to active customers via email 30 days in advance
- Effective 30 days after posting unless Customer objects in writing
Continued use of the Service after changes become effective constitutes acceptance of modified Terms.

These Terms of Service constitute the entire agreement between Customer and CaseCapture AI regarding use of our Voice AI agent service for family law firms.
